I examine the discovery, establish relevant conduct parameters, review your client's criminal history, and project his/her offense level, criminal history category, and resulting guideline imprisonment range, before a plea is entered. I create a document for you to share with your client which assigns criminal history points for each prior conviction, establishes a base offense level and assigns applicable guideline adjustments from Chapters 2, 3 and 4 of the Advisory Guidelines. I also identify potential upward and downward departure and variance issues. Where applicable, I can determine immediately if your client is a Career Offender or an Armed Career Criminal. I also identify prior convictions which might subject your client to statutory sentencing enhancements under 21 USC 841(b)(1)(A), (b)(1)(B), and (b)(1)(C).
I assist you in negotiating the most favorable outcome for your client and suggest plea agreement stipulations which will limit your client's exposure under the advisory guidelines. I calculate the probable guideline range for the counts of conviction and also project release dates from the Bureau of Prisons (BOP).
Pre-Sentence Report (PSR) Review
I review the PSR and ensure that the advisory guidelines have been accurately applied. I help you formulate objections and identify areas that might warrant consideration for a variance or downward departure. I interview family members (if needed) and assist in the preparation of sentencing memorandums.
Sentencing Hearing Prep
I prepare an outline of the mitigating factors to be stressed at sentencing and identify points that should be made (and things to avoid) during the hearing.
